Fly Away to Rachael Ray Contest
OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY:  The Contest is open to legal residents of  Western Washington who are 18 years or older at the time of entry.  Void where prohibited by law. Winners of previous Pacific Medical Centers (PMC) or KIRO 7 contests are not eligible to win another PMC or KIRO 7 contest within a 90-day period. 

Employees, temporary employees, independent contractors and interns of Pacific Medical Centers ("Sponsor"), their respective subsidiaries, parents, partners, other contest sponsors, advertising and promotional agencies (hereinafter “Pacific Medical Centers”) and the immediate family members of each, are not eligible to win prizes.

DEADLINES:  The contest entry period begins on September 4, 2008 and ends on September 28, 2008.

HOW TO ENTER:  You may enter two ways:  (1) online at pacmed.org and provide your name, address and email address or (2) Mail a postcard with your name, age, address, and daytime phone to: Pacific Medical Centers – Flyaway to Rachael Ray Contest, c/o Pacific Medical Centers, 1200 12th Avenue S., Quarters 6/7 Seattle WA  98144.  All mail entries must be received by the posted deadlines. (see Deadlines below). All online entries must be received by midnight (Pacific time) on September 28th.  No mechanically reproduced mail-in entries will be accepted.  ONE ENTRY PER PERSON REGARDLESS OF METHOD OF ENTRY. 

Entries must be postmarked by the stated deadline.   No submissions will be accepted after the deadline for any reason.

No responsibility is assumed by Pacific Medical Centers, KIRO 7, their respective subsidiaries, parents, partners, or other contest sponsors for lost, late, postage-due, misdirected, or illegible entries. All entries become the property of Pacific Medical Centers and will not be returned to the Contestant. Sponsor further reserves the right to disqualify any entry that is alleged to infringe on any third-party’s intellectual property rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience. Contestants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, or otherwise display or use entries in any way it sees fit without limitation or compensation to contestants.

WINNER SELECTION:  From all eligible entries received, one (1) Grand Prize winner will be (random) selected by Pacific Medical Centers management on or around September 29, 2008.  Selection is subject to verification of eligibility and compliance with conditions.  Winner does not need to be present to win.  Decision of Pacific Medical Centers management acting as judges in this contest shall be final and binding in all respects.

ODDS OF WINNING:  Odds of winning depend on the number of eligible entries received.

PRIZE:

One lucky winner will win a 3-day, 2-night trip for two to New York City to attend a taping of the Rachael Ray show including round-trip coach airfare from SeaTac, two nights hotel accommodations, meet and greet with Rachael Ray, autographed cookbook, and a $500 shopping spree. Trip must be taken between October and December of 2008, subject to availability. In the event of show or production cancellation, sponsors will have no further obligation than to provide the trip to New York City (hotel and air transportation). Taxes, amenities, gratuities and other expenses are the sole responsibility of the winner. (Retail Value: $2,270)

Winner is responsible for all applicable federal, state, and local income and any other taxes, fees and surcharges.  An IRS Form 1099 will be issued for all prizes with a retail value in excess of $600.   Pacific Medical Centers reserve the right to substitute a prize of equal or greater value.

WINNER NOTIFICATION:  Winners will be notified on or about September 29, 2008 by telephone number, U.S. mail and/or overnight courier provided on the winner's entry.  Sponsor will call only once during regular business hours at number provided on entry form.  Winner will have 48 hours to return call and claim prize.  Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected.   Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark.  Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. 

USE OF CONTEST INFORMATION:  Contestants grant to Pacific Medical Centers, and Pacific Medical Centers reserve, the right to use any and all information related to the Contest, including information provided by Contestants in connection with the Contest, for marketing purposes or any other purpose, unless prohibited by law.  By accepting a prize, winner(s) may be required to sign a release that grants permission to Pacific Medical Centers to use his or her name, photograph, likeness, voice, prize information and/or biographical information for publicity and promotional purposes without future compensation unless prohibited by law.  By entering, participants release and hold harmless Pacific Medical Centers, their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Contest or any prize won.

CONDUCT:  By entering the Contest, you agree to be bound by these Official Rules.  Contestants further agree to be bound by the decisions of the Pacific Medical Centers, which shall be final and binding in all respects. Pacific Medical Centers reserve the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or to be acting in violation of the Official Rules.

You agree that in your participation in the Contest you will not use obscene, libelous or slanderous language, or language that infringes upon a third party's trademark, trade name or other intellectual property right or right of privacy. You agree to indemnify and hold harmless Pacific Medical Centers, KWP Studios Inc., CBS Television Distribution, The Rachael Ray show, their respective subsidiaries, parents, partners, or other contest sponsors, officers, consultants, agents, and employees against and from all claims, damages liabilities, costs and expenses asserted by third parties alleging that the Contest includes obscenity, libel, slander, or infringes upon the third party's intellectual property or privacy rights, as a direct result of your actions in connection with the Contest. You further agree to not knowingly damage or cause interruption of the Contest or to prevent others' participation in the Contest.

LIMITATIONS OF LIABILITY:  Winners assume liability for losses or injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize.  Pacific Medical Centers are not responsible: (i) for any lost, late, illegible, incomplete, postage-due, misdirected or mutilated mail; or (ii) for any incorrect or inaccurate information, in the Contest or by any technical or human error that may occur in the processing of submissions in the Contest. Pacific Medical Centers assume no responsibility for an error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of authorized access to, or alteration of, entries. If the Contest is not capable of running as planned for any reason, including legal restrictions, tampering, unauthorized intervention, fraud, or any other causes beyond the control of Pacific Medical Centers that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Pacific Medical Centers reserve the right to cancel, terminate, modify or suspend the Contest.  You agree to release KWP Studios, Inc., CBS Television Distribution, the Rachael Ray show, and all of their respective parent corporations, affiliates, subsidiaries, employees, officers and directors from any and all claims, losses or causes of action arising in any way from this contest and/or the use or misuse of any prize.

RULES / WINNERS LIST:  Official Rules and the name of the winner may be obtained by sending a self-addressed, stamped #10 envelope to: Pacific Medical Centers 1200 12th Avenue S., Quarters 6/7 Seattle WA  98144. Indicate “Fly Away to Rachael Ray Official Rules” or “Fly Away To Rachel Ray Winner List" on the outside of the envelope as applicable. Limit one (1) request per envelope. INTELLECTUAL PROPERTY: The names, logos, and icons identifying the products and services of Sponsor are proprietary marks of Pacific Medical Centers. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited. 

GENERAL CONDITIONS:  This Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law.
